Pro Rata Temporis

The term Pro Rata Temporis comes from Latin and means “proportionally according to time.” In practice, it is often used to calculate vacation entitlements, salaries or working hours for part-time or short-term employees. For example, if an employee worked only part of the year or works part-time, the entitlement to vacation or salary is calculated according to actual working hours.

When calculating vacation according to Pro Rata Temporis, the entitlement is adjusted to the time actually worked. For example, if an employee has worked six months of a year, he receives only half of the annual vacation. The situation is similar for parttime workers whose vacation is also calculated in proportion to working time.

This principle ensures that both full-time and part-time employees or employees with fixed-term employment contracts are treated fairly by only receiving what they have worked out during the corresponding working hours.
